"Scalia Dissents"
Mar. 25th, 2006 12:48 pmOne wonders how well Scalia gets along with his colleagues:
- "Special risk" is pretty flabby language.
- The arrogance of this assumption of power takes one's breath away.
- As its instrument of destruction, the bulldozer of its social engineering, the Court invents a boundless, and boundlessly manipulable, test of psychological coercion.
- It's fanciful enough to say... It is beyond the absurd to say ...
- (The Court) essentially apply it when it seems like a good idea to load the dice.
- many aggressively proabortion novelties announced by the Court
sub silentio - In silence
stare decisis - To stand by things decided
habeas corpus - You must have the body, i.e. You must justify an imprisonment
amicus curiae - Friend of the court
res ipsa loquitur - The thing speaks for itself
