One wonders how well Scalia gets along with his colleagues:
  • "Special risk" is pretty flabby language.
  • The arrogance of this assumption of power takes one's breath away.
  • As its instrument of destruction, the bulldozer of its social engineering, the Court invents a boundless, and boundlessly manipulable, test of psychological coercion.
  • It's fanciful enough to say... It is beyond the absurd to say ...
  • (The Court) essentially apply it when it seems like a good idea to load the dice.

plebiscite: A direct vote in which the entire electorate is invited to accept or refuse a proposal.
certiorari:  A writ from a higher court to a lower one requesting a transcript of the proceedings of a case for review.
adduce: To cite as an example or means of proof in an argument.
