"Scalia Dissents"
Mar. 12th, 2006 07:12 pmToo bad that being bitingly sarcastic is only socially rewarding for a small crowd. On top of it, Mr. Scalia got to make Chuck Norris jokes at work - 'Facial features are the primary means by which human beings recognize one another... it is why the Lone Ranger wears a mask insted of a poncho.'
'Morrison v. Olson (1988)':
- If to describe this case is not to decide it, the concept of a government of separate and cooridnate powers no longer has meaning.
- The qualifier adds nothing but atmosphere.
- Evidently, the government standard is to be what might be called the unfettered wisdom of a majority of this Court, revealed to an obedient people on a case-by-case basis.
- It is in fact comforting to witness the reality that he who lives by the ipse dixit dies by the ipse dixit. But one must grieve for the Constitution.
- The fairness of a process must be adjudged on the basis of what it permits to happen, not what it produced in a particular case.
